Chapter 135. Retirement System for Teachers and State Employees; Social Security; Health Insurance Program for Children.

ARTICLE 4. Consolidated Judicial Retirement Act.

§ 135-73. Termination or partial termination; discontinuance of contributions.

In the event of the termination or partial termination of the Retirement System or in the event of complete discontinuance of contributions under the Retirement System, the rights of all affected members to benefits accrued to the date of such termination, partial termination, or discontinuance, to the extent funded as of such date, or the amounts credited to the members' accounts, shall be nonforfeitable and fully vested.

Editor's Note. - Session Laws 1987, c. 177, s. 1(c), made this section effective upon the first day of the calendar month following the State's receipt of a favorable letter of determination or ruling from the Internal Revenue Service, United States Department of Treasury, that the Retirement Systems were qualified trusts under Section 401(a) of the Internal Revenue Code of 1954 as amended. A favorable letter was received prior to the enactment of c. 177.
